laresidenceinteriors.co.uk is a site operated by La Residence Interiors Limited, a company registered in England and Wales under registration number 09161450. 2. Your status

By placing an order through our site, you warrant that:

(a) you are legally capable of entering into binding contracts; and

(b) you are at least 18 years old.

3. Payment

We accept Visa, Mastercard, American Express, Maestro. Payments will be processed on the day you place your order.

4. Pricing

Prices include VAT at 20% and exclude delivery charges unless otherwise stated. We reserve the right to alter prices at any time. It may be necessary to change prices either up or down, from time to time, including any alterations to the rate of VAT. 

5. How the contract is formed between you and us

5.1 Your order constitutes an offer to us to buy Goods and services linked to buying the Goods (“Order”). All Orders are subject to acceptance by us, which we are free to accept or decline at our absolute discretion. We will confirm our acceptance of your Order by sending you an e-mail confirming our acceptance (“Order Confirmation”). The contract between us will only be formed when we send you our Order Confirmation.

5.2 We shall assign an order number to the Order and inform you of it in the Order Confirmation. Please quote the order number in all subsequent correspondence with us relating to the Order.

5.3 We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, technology, payment methods, relevant laws and regulatory requirements and/or in our system's capabilities. You will be subject to the policies and terms in force at the time that you order the Goods from us, unless any change to those policies or these terms is required by law or government or regulatory authority (in which case, it will apply to orders you have previously placed that we have not yet fulfilled).

6. Product Information

We do our very best to ensure that all items you see are as close as possible to the photographs shown, but, since they are not mass-produced, slight variations in colour and size may occur from time to time.  

7. Delivery

Either we or our nominated delivery partner will contact you to notify you when your Products are available and will arrange a date for delivery to the address specified by you.

Our nominated delivery partner will deliver your Products to any address in the UK or Ireland. The charges will vary, but will be indicated when you place your order. We reserve the right to require proof of identification from you when making a delivery to you.

You are required to take delivery on the date agreed between us, otherwise we reserve the right to charge you an additional re-delivery fee. This payment will be due before re-delivery.

Our delivery partner for furniture items will contact you to schedule a delivery date. They will provide an estimated delivery time slot once the delivery route has been planned. If you cancel the delivery later than 8am on the day two days before your delivery date or if you are not available to accept the delivery when our delivery partner arrives at your address within the agreed time slot, we reserve the right to charge you for the cost of the delivery (£60.00) in addition to any delivery charge already paid.

Time of delivery is not of the essence in these terms and conditions. We will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any delay.

8. Cancellation

8.1 Should you wish to cancel and/or amend your order you should contact La Residence Interiors in writing, by email or by telephone. Details of your statutory right of cancellation are provided in our Order Confirmation. This provision does not affect your other statutory rights as a consumer. Advice about your legal rights is available from your local Citizen Advice Bureau or trading standards office.

8.2 Subject to clause 9.1 you can cancel your order by notifying us in writing at anytime from placing the Order up to the expiry of 14 working days starting the day after the date the Goods are delivered.

8.3 Should you cancel your Order in accordance with the provisions of clauses 9.1 once it has been delivered, we will collect such Goods.

8.4 We will charge a collection cost for the Goods that we collect under the provisions of clause 8.3 above. The collection cost will depend on the nature of the Goods and where and when it is to be collected from. This cost will be notified to you in advance.

If you cancel an order more than 48 hours after it has been placed and the item(s) have been shipped for delivery we reserve the right to charge a collection fee of £60 for England and £90 for elsewhere in the UK.

In any event the Goods will remain your responsibility until we collect the Goods. You should also be aware of the following obligation:

Any collection will be from the delivery address unless we agree otherwise, and we will agree with you a suitable day for collection. If you are not going to be available for collection yourself, you must notify us in advance of a nominated adult who will be present for the collection. You must ensure that on the day of collection the access to the Goods is clear and free from obstruction. 

8.5 You have a statutory duty to take reasonable care of the Goods. If you breach this duty we have a right of action against you. If any original packaging has been left with you please return the Goods with the original packaging. If the original packaging is not available, then please ensure any items to be returned are packaged in a suitable and sufficient manner so as to ensure that there is no risk of damage in transit.

8.6 In the event that you do not comply with the above obligations, we may require payment from you of all costs reasonably incurred by us which may include but is not limited to wasted collection journeys or the cost of any Goods which you have damaged or lost.

9. Refunds and returns

9.1 When you return a Product to us:

(a) because you have cancelled the Contract between us within the 14 day cooling-off period (see clause 8.2 above), we will process the refund due to you as soon as possible and, in any case, within 14 days of the day on which we receive the Product back or the date on which you provide evidence of having sent the Product to us. In this case, we will refund the price of the Product in full provided that there is no evidence of use. There will be a collection fee of £60 payable prior to collection by our delivery partner.

(b) for any other reason (for instance, because you consider the Goods are faulty), we will discuss the issue with yourselves and, if necessary examine the returned Goods. Should we agree the Goods are faulty we would reserve the right to discuss with you whether it would be more appropriate to repair the Goods in question. Should we agree with you that the Goods should be returned and you should obtain a refund, we will notify you of your refund via e-mail within a reasonable period of time. We will process the refund due to you as soon as possible after we have confirmed to you via e-mail that you are entitled to a refund. We will refund the price of the Goods in full, any applicable delivery charges and not charge you any collection charge for collecting the Goods from you.

9.2 We will usually refund any money received from you using the same method originally used by you to pay for your purchase.

10. Availability

All items are subject to availability.

We will inform you as soon as possible if goods you have ordered are not available.

11. Guarantees

11.1 The provisions of this clause 11.Guarantees apply in addition to your statutory consumer rights in relation to faulty or mis-described goods. These rights are not affected by the guarantee.

11.2 All furniture items purchased have a 1-year guarantee from the date of delivery. This guarantee is against faulty workmanship and/or faulty materials, with the exception of fillings and coverings.

11.3 These guarantees do not cover fair wear and tear, neglect, abuse or misuse of your goods, loss or damage due to unreasonable exposure to water, heat or weather; loss or damage due to fire, smoke, explosion, lightning, sunlight, infestation by animals or boring insects, damage by animals generally or theft, or accidental damage or loss caused by a third party. If you are a consumer, this warranty is in addition to, and does not affect, your legal rights in relation to Products that are faulty or not as described. 

11.4 In the event of a claim under guarantee occurring, please email: contact@laresidenceinteriors.co.uk giving your order number, your address, contact details and a summary of the problem with accompanying photos if requested. We will then notify you whether the claim is valid via telephone or e-mail within a reasonable period of time.

11.5 In the event of an accepted claim we will endeavour to repair the defective goods free of charge. If a repair is not possible you will be offered a replacement and only if a suitable replacement is not available will you be offered a refund.

11.6 We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered goods, over and above the value of the actual goods themselves supplied by us. This does not affect your statutory rights.

11.7 Our guarantees are limited to goods sold and retained in the United Kingdom and Ireland and used solely in private residences and not in commercial or rental properties.


12. Liability

12.1 We warrant to you that any Product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.

12.2 Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Product you purchased and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

12.3 This does not include or limit in any way our liability:

  • for death or personal injury caused by our negligence
  • under section 2(3) of the Consumer Protection Act 1987
  • for fraud or fraudulent misrepresentation
  • for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

12.4 We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us, including but not limited to:

  • loss of income or revenue;
  • loss of business;
  • loss of profits or contracts;
  • loss of anticipated savings;
  • loss of data; or
  • waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise, provided that this clause 12.4 shall not prevent claims for loss of or damage to your tangible property that fall within the terms of clause 12.1 or clause 12.2 or any other claims for direct financial loss that are not excluded by any of categories inclusive of this clause 12.4.

However, La Residence Interiors does not warrant that such information will be error free and the user acknowledges that information, products and services published on this web site may include inaccuracies and typological errors. If the goods do not on receipt by you substantially meet the description on this web site you are entitled to reject the goods and return them to us.

13. Import duty

13.1 If you order Products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

13.2 Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

14 International shipping

14.1 These additional terms apply where you are ordering from outside the UK and you require delivery of a Product to a location outside the UK or Ireland.

14.2 Where these terms differ from or conflict with our standard terms then these will apply.

14.3 We can deliver to any port in the UK or Ireland agreed with you at the time of accepting your order and it is for you to arrange for the onward shipping.

14.4 It is your responsibility to check the condition of the Product at the location where we deliver (this can either be you personally, a representative of the shipping company, a relative or an employee of yours).

14.5 You are responsible for the Product as soon as it is delivered to you or your agent at the relevant port or when it is signed for by you or your agent. Please note that your right of return will be different for outside the UK.

14.6 Products transported outside the UK may be subject to customs, handling, import and/or export duties, and may require licences, clearances and other consents in order for the Product to be so transported. You will be responsible for the payment of any such duties and for obtaining and maintaining any such licences, clearances and consents. We therefore recommend that you contact your local customs office or an experienced export carrier for further information before placing your order.

14.7 You must comply with all applicable laws and regulations of the territory of final destination for the Product. We shall not be liable for any breach by you of any such laws and regulations.

14.8 Where you have arranged for a Product to be shipped to a location outside the UK or Ireland, you still have the right to return the Product but it is your responsibility to arrange for and pay for the Product to be shipped back to the UK or Ireland so that we can collect it. We will collect the Product from the UK or Ireland depot which we delivered it to.
