1. Purpose of this privacy policy

1.1 This privacy policy aims to give you information on how La Residence Interiors collects and processes your personal data through your use of our website including any data you may provide through our website when you purchase a product or service, order a fabric or wood sample, sign up for our newsletter or when we take your details (collect your personal data) over the phone, by email or in our showroom in order to take your order or answer any questions you have about our products. It is important that you read this privacy policy together with any other privacy policy or fair processing notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy policy supplements the other notices and is not intended to override them.

3.1 This version was last updated on 04/09/2019. It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

4. When do we collect personal data from you?

4.1 We may collect and process the following data about you:

  • When you make an online purchase
  • When you purchase a product in our showroom or by phone
  • When you order samples from us
  • When you sign up for our email newsletter
  • When you engage with us on social media
  • When you contact us by any means with queries, complaints, etc
  • When you enter prize draws or competitions
  • When you complete any surveys we send you
  • When you comment on or review our products and services
  • When you interact with our website, we may automatically collect Technical Data about your equipment, browsing actions, patterns and the website that referred you to laresidenceinteriors.co.uk. We collect this personal data by using cookies, server logs and other similar technologies. Technical Data is collected from the following parties: analytics and search information providers (such as Google) and advertising networks (such as AdRoll).
  • When you've given a third party permission to share with us information they hold about you.
  • We collect data from publicly-available sources when you have given consent to share information or where the information is made public as a matter of law.
  • When you apply for a trade account with us through our website, over the phone or in our showroom.

5. Personal data we may collect from you

5.1 Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together follows:

  • Identity Data including first name, last name, title. 
  • Contact Data including billing address, delivery address, email address, telephone numbers. We will also collect your social media username, if you interact with us through those channels.
  • Financial Data including bank account and payment card details
  • Transaction Data including details about payments to and from you and other details of products you have purchased from us
  • To deliver the best possible web experience, we collect Technical Data including internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our website.
  • Profile Data including purchases or orders made by you, your interests, preferences, feedback and survey responses.
  • Usage Data including information about how you use our website. This includes information gathered by the use of cookies in your web browser. 
  • Marketing and Communications Data includes your preferences in receiving marketing from us and your communication preferences.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

6. How and why we use your personal data

6.1 We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract we are about to enter into or have entered into with you.

    • Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). 6.2 Generally we do not rely on consent as a legal basis for processing your personal data other than in relation to sending third party direct marketing communications to you via email or text message.

Examples of how we use information held about you include:

  • To process any orders that you make on our website or in our showroom. If we don't collect your personal data during checkout, we won't be able to process and deliver your order and comply with legal obligations. For example, your details may need to be passed to a third party to supply or deliver the product or service that you ordered, and we may keep your details for a reasonable period afterwards in order to fulfil any contractual obligations such as refunds, guarantees and so on.
  • To respond to your queries, refund requests and complaints. Handling the information you send enables us to respond. We may also keep a record of these to inform any future communication with us and to demonstrate how we communicated with you throughout. We do this on the basis of our contractual obligations to you, our legal obligations and our legitimate interests in providing you with the best service and understanding how we can improve our service based on your experience.
  • To protect our customers, premises, assets and staff from crime, we operate CCTV in our showroom and car park which record images for security. We do this on the basis of our legitimate business interests.
  • To process payments and to prevent fraudulent transactions. We do this on the basis of our legitimate business interests. This also helps to protect our customers from fraud.
  • If we discover any criminal activity or alleged criminal activity through our use of CCTV, fraud monitoring and suspicious transaction monitoring, we will process this data for the purposes of preventing or detecting unlawful acts. We aim to protect the individuals we interact with from criminal activities.
  • To send you relevant communications by email or post in relation to updates, products and services. We'll do this on the basis of our legitimate business interest.   • To administer any of our prize draws or competitions which you enter.
  • To develop, test and improve the systems, services and products we provide to you. We'll do this on the basis of our legitimate business interests.

  • To send you survey and feedback requests to help improve our services. These messages will not include any promotional content and do not require prior consent when sent by email or text message. We have a legitimate interest to do so as this helps make our products or services more relevant to you.
  • To build a picture of who you are and your interests, and to inform our business decisions, we'll combine data captured by La Residence Interiors, third parties and data from publicly-available lists as we have described in the section 'Personal Data we collect from you?' We'll do this on the basis of our legitimate business interest.

7. Who do we share your data with?

7.1 We may have to share your personal data with the parties set out below for the purposes outlined in 6. How and why we use your personal data.

Examples of the kind of third parties we work with are:

  • Google, Facebook, Pinterest and AdRoll to show you products that might interest you while you're browsing the internet. 8. How we protect your data

8.1 The security of your personal data is very important to us and we are committed to treating it with the utmost care, taking all appropriate steps to protect it.

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality. Access to your personal data is password-protected, and sensitive data (such as payment card information) is secured and tokenised to ensure it is protected.

We secure access to all transactional areas of our websites and apps using 'https' technology.

The platform that we use is regularly monitored for possible vulnerabilities and attacks and uses encryption protocol used to secure communications over the internet.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

9. How long will you keep my data for?

9.1 We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. For example, if your order included a product guarantee, the associated personal data will be kept until the end of the guarantee period.

At the end of that retention period, your data will either be deleted completely or anonymised, for example by aggregation with other data so that it can be used in a non-identifiable way for statistical analysis and business planning.

10. What are your rights over your personal data?

10.1 Under certain circumstances, you have rights under data protection laws in relation to your personal data.

You have the right to:

Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

No fee usually required

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
